Baggage / Limit of Liability
. If checking in fragile, perishable or valuable items

Air Europa does not accept liability, beyond legally established limits, for damage to checked items that are fragile (glass bottles, paintings, crafts, souvenirs, etc.), perishable, money, foreign currency, jewellery, works of art, precious metals, silverware, deeds, expensive garments, optical and/or electronic devices, all types of cameras, musical instruments, corporate documents, securities, samples, shares, passports or other documents, any other valuable items, and badly packed sports equipment. The passenger may opt for a higher liability limit by making a special declaration, no later than at the time of checking in, and by paying a supplementary fee.   

. After leaving the baggage reclaim area

You are informed that in the event of an incident (loss, delay or damage) involving your checked baggage, before leaving the baggage hall you must go to the Incident Desk in the baggage reclaim area to put your complaint in writing and fill in a Property Irregularity Report (PIR). This is a mandatory requirement for recording the occurrence and allows the airline to process the incident.
If a PIR is not filled in, the company will not assume liability for the baggage in accordance with Article 31.1 of the Convention for the Unification of Certain Rules for International Carriage by Air done at Montreal on 28 May 1999 and Article 3.1 of Council Regulation (EC) 2027/97 of 9 October 1997.

. Minor damages

In accordance with art. 17.2 of The Montreal Convention, carriers will not be liable for the damages resulting from the nature, inherent defect or a vice of the baggage.

In this sense, the normal use of the baggage, produces wear and tear in the baggage structure, therefore arising in the mentioned defects and a vices whose common result is the wear of them.

Likewise, the wrong use of the baggage, not observing the manufacturer's specifications regarding weight and maximum capacity, can also arise in damage whose liability must be taken on by the passenger.

For above mentioned reasons and according to The Montreal Council, carriers will not be liable for minor damages and accessories protruding from the baggage which may have caused the damage explained above.
