In accordance with article 1878 of the Commercial Code, passengers may withdraw from the trip before it begins, by notifying the carrier or travel agency at least twenty-four (24) hours before the flight departs. In these cases, the carrier or travel agency may withhold a sum of money, in accordance with the regulations of this item.
The carrier or travel agency, in accordance with the conditions of the fare, may retain the agreed percentage, which may not exceed 10% of the value of the fare, excluding duties, taxes and administrative fees. Any retention against the passenger will be done in favour of the carrier.
The provisions of this item will not apply when it comes to promotional fares, unless offered by the carrier, in which event it will be applied in accordance with the conditions offered.
Withdrawal in the event of sales made through non-traditional distance-selling methods
In accordance with the provisions of Article 47 of Act 1480, in cases of purchases made through financing systems granted by the producer or supplier, the sale of timeshares or sales using non-traditional or distance methods, the right of withdrawal shall be understood to have been agreed in favour of the consumer.
Where the passenger or consumer decides to withdraw from the contract, they shall do so within five (5) days after it has been entered into, provided that the service has not begun before these five (5) days.
When the passenger exercises the right of withdrawal in full compliance with the conditions set out above, the contract of carriage shall be terminated and the money paid by the consumer shall be refunded within thirty (30) calendar days.
The right of withdrawal shall be exempted in cases where the service has started to be provided with the agreement of the consumer, and in other cases provided for by law.
