Conditions of carriage

Tickets issued by Air Europa are subject to the following conditions of carriage.

Agreed stopovers

These are places, not including the place of departure or destination, set forth on the Ticket or indicated in the Carrier's itinerary as scheduled stops on the passenger's journey.

Carriage

The carriage of passengers and luggage, from the place of boarding to the place of disembarkation, as defined in the applicable law.

Airline code

The alphanumeric code containing two or three characters that identifies the different air carriers.

Authorised Agent

The sales agent designated by the Carrier to represent it in the sale of its services and, when authorised, the services of other air carriers in the carriage of passengers by air.

Baggage

The personal belongings that the passenger takes with them on their trip. Unless otherwise specified, it includes both checked and unchecked luggage.

Applicable Law

Any international, EU or national regulation that affects the carriage of passengers by air and their luggage, cargo and mail, including, but not limited to, the Council Agreement or Regulation (EEC) No. 2027/97 with respect to the responsibility of the transport company in the event of accident, dated 9 October 1997, modified by Regulation 889/2002, of 13 May 2002, and Regulation (EC) 261/2004, of the European Parliament and the Council of 11 February 2004, which establish common standards on compensation and assistance to air passengers who are denied boarding or whose flight is cancelled or is subject to a major delay and repeals Regulation (EEC) No. 295/91 and where applicable the Air Travel Act 48/1960, of 21 July, with its modification in the Royal Decree 37/2001, dated 19 January.

Baggage receipt

The parts of the ticket related to the passenger's checked baggage, including a receipt for claims issued by the carrier to be attached to the ticket.

Carrier

Air Europa or any other air carrier that undertakes the carriage of passengers and their luggage or provides any other service related to said carriage by air, which is governed by the provisions of these General Conditions of Carriage.

Charter transport

Carriage performed by a real carrier who, with the authorisation of the contracting carrier (Charterer or Tour Operator), performs the entire or partial carriage as per a charter contract.

Baggage tag

The document issued by a Carrier that is attached to a certain piece of checked baggage for identification purposes.

Baggage check-in period

The time limit specified by the Carrier within which the passenger must have completed the baggage check-in process and received their boarding pass.

Terms and conditions of the contract

The clauses written on the ticket, or handed over with it, or on the receipt-itinerary (printed itinerary), identified as such and which include these Conditions of Carriage by reference.

Community air carrier

Air Europa or any other carrier with a valid operating permit granted by a member state of the European Union in accordance with Regulation (EEC) No. 2407/92, of 23 July 1992.

Booking confirmed

This means that the passenger has a ticket that contains the following:

a) In the case of a printed ticket, the number, date and time of the flight and the OK annotation in the appropriate space; or

b) In the case of an electronic ticket or a non-printed carriage document, the indication that the booking has been registered and confirmed.

Connecting journey ticket

A ticket issued to a passenger with a connecting journey; together, both constitute a single Contract of carriage.

Convention

Any of the following instruments applicable to the contract of carriage:

  • (i) Convention for the Unification of Certain Rules for International Carriage by Air, signed in Montreal on 28 May 1999; and alternatively
  • (ii) Convention for the Unification of certain rules relating to international carriage by air, signed in Warsaw on 12 October 1929 (hereinafter referred to as the Warsaw Convention);
  • (iii) The Hague Protocol of 28 September 1955, which amends the Warsaw Convention;
  • (iv) Montreal Protocols nos. 1, 2 and 4 (1975), which complement the Warsaw Convention.

Coupon

Both the Flight Coupon and the Electronic Coupon, which allow the passenger whose name appears on it to travel on the corresponding flight.

Damage

Includes death, wounds or bodily injuries suffered by the traveller or loss, partial loss, theft or any other damage that may arise as a result or in connection with the flight or other additional services provided by the carrier.

Days

Calendar days, including the seven days of the week, provided that, for notification purposes, the day on which the notice is sent is not included and that, for the determination of the duration of the validity of the ticket, the day of its issue or the day of the start of the flight are not taken into consideration.

Domestic flight

All flights departing and arriving in cities within the territory of the same country or a single airspace, excluding those that have scheduled stops in the territory of any other State.

International flight

Any flight whose departure and arrival points are located in two different countries. In accordance with applicable law, all flights with departure and arrival in cities located within the territory of the same country are international if a technical stop is scheduled in another country.

Electronic coupon

Any Electronic Flight Coupon or any other valid document recorded and kept in our database.

Electronic ticket

The printed itinerary issued by the carrier or on behalf of a carrier, the electronic coupon and, if applicable, a boarding document.

Flight coupon

The portion of the ticket issued by the carrier or on behalf of the carrier that bears the "valid for carriage" indication and specifies the places where the passenger has the right to be carried. In the case of an electronic ticket, it is called the electronic coupon.

Force majeure

Any extraordinary and unforeseen circumstances beyond the control of the passenger and/or the carrier, whose consequences could not have been avoided even if all the necessary precautionary measures had been taken.

Passenger

Any person, except the crew, in possession of a ticket who is being transported or is to be transported on an aircraft.

Person entitled to compensation

Any passenger or person entitled to file a claim on the former's behalf in accordance with applicable law.

Passenger coupon or passenger voucher

The part of the ticket issued by Air Europa or in our name that is identified as such and remains in the passenger's possession.

Safety elements

Any object or device that, for safety reasons, cannot be carried on board in accordance with applicable law.

Special Drawing Rights (SDRs)

A unit of account unit established by the International Monetary Fund (IMF) whose value is determined periodically by said entity.

Stopover

A scheduled stop on the trip at a point between the place of departure and the destination.

Fare

The prices of the published tickets, the fees and/or the Conditions of Carriage related to a carrier that must be presented when the corresponding authorities require it.

Ticket

The document called the "Passenger Ticket and Baggage Receipt" or the Electronic Ticket issued by Air Europa or on our behalf, which includes or incorporates by reference the Contract Conditions, notifications and coupons.

Hand luggage

The passenger's non-checked baggage.

1. General

(a) These Conditions of Carriage apply only to flights or flight segments in which our designator code appears in the ticket's carrier box for that flight or flight segment.

(b) These Conditions of Carriage also apply to reduced fares and free transport, except when Air Europa has stated otherwise in the Contract of Carriage or in any other contractual document.

(c) These Conditions of Carriage must be interpreted in accordance with applicable law and, unless it is contrary to the aforementioned applicable law, with IATA agreements.

2. Charter operations

If the carriage is carried out as per a charter agreement, these Conditions of Carriage are applied according to the terms stated in the charter agreement or on the ticket.

3. Code sharing

As per Article 1, Air Europa has agreements with other carriers for some of its services, known as "code sharing". By virtue of these agreements, even if passengers have a booking with Air Europa and the ticket box corresponding to the carrier contains the name or designator code of Air Europa, the flight can be executed by another carrier.

4. Mandatory law

These conditions of carriage are applicable unless they contradict the law or the fares applicable by Air Europa, in which case said law or fares will prevail. If any provision of these conditions of carriage is invalidated by the application of said law, the other provisions will remain valid.

5. The conditions prevail over the regulations

Except where otherwise stipulated, these conditions of carriage will prevail even if they conflict with some other regulation that Air Europa has regarding certain matters.

6. Information on the identity of the operating company

Air Europa will inform passengers about the identity of the airline operators in the contracted airline carriage services. 

1. General

(a) These Conditions of Carriage apply only to flights or flight segments in which our designator code appears in the ticket's carrier box for that flight or flight segment.

(b) These Conditions of Carriage also apply to reduced fares and free transport, except when Air Europa has stated otherwise in the Contract of Carriage or in any other contractual document.

(c) These Conditions of Carriage must be interpreted in accordance with applicable law and, unless it is contrary to the aforementioned applicable law, with IATA agreements.

2. Charter operations

If the carriage is carried out as per a charter agreement, these Conditions of Carriage are applied according to the terms stated in the charter agreement or on the ticket.

3. Code sharing

As per Article 1, Air Europa has agreements with other carriers for some of its services, known as "code sharing". By virtue of these agreements, even if passengers have a booking with Air Europa and the ticket box corresponding to the carrier contains the name or designator code of Air Europa, the flight can be executed by another carrier.

4. Mandatory law

These conditions of carriage are applicable unless they contradict the law or the fares applicable by Air Europa, in which case said law or fares will prevail. If any provision of these conditions of carriage is invalidated by the application of said law, the other provisions will remain valid.

5. The conditions prevail over the regulations

Except where otherwise stipulated, these conditions of carriage will prevail even if they conflict with some other regulation that Air Europa has regarding certain matters.

6. Information on the identity of the operating company

Air Europa will inform passengers about the identity of the airline operators in the contracted airline carriage services. 

1. General provisions

(a) Air Europa will only transport the passenger whose name appears on the ticket, and it may ask the passenger to present their identification (National Identity Document, Passport or equivalent).

 

(b) The ticket is non-transferable.

 

(c) Some tickets are sold at discounted prices, which may be partially or totally non-refundable. Some tickets also do not include checked baggage allowance.

 

(d) If, due to force majeure in the terms indicated in Article 1, a passenger with a ticket that meets the characteristics described in Section (c) is prevented from carrying out the trip and has therefore not used any segment of said ticket, Air Europa must transport the passenger on a future flight, provided that they notify Air Europa immediately and submit the evidence corroborating said force majeure event.

 

(e) The ticket is owned by the issuing carrier at all times.

 

(f) With the exception of electronic tickets, passengers will not be entitled to carriage on a flight unless they present a valid ticket containing the flight coupon for the flight in question and all other unused flight coupons and the passenger coupon. Furthermore, passengers will not be entitled to carriage if the ticket is damaged or has been modified by someone other than Air Europa or an Authorised Agent. With the exception of electronic tickets, passengers will not be entitled to carriage on a flight unless they present an authentic ID document and a valid ticket that has been duly issued in their name.

 

(g) In the event the passenger loses or damages all or part of their ticket or the passenger does not present a ticket containing the passenger coupon and all unused flight coupons, Air Europa, at the passenger's request, will replace all or part of the ticket by issuing a new one, provided that there is evidence, submitted in due time, that a valid ticket for the flight(s) in question was duly issued and provided that the passenger signs an agreement by which they agree to reimburse Air Europa for all costs and losses that Air Europa or another carrier has incurred as a result of the passenger's misuse of the ticket. If such losses are caused by negligence attributable to Air Europa, the latter will not be entitled to claim any reimbursement from passengers in this respect. The carrier issuing the ticket may charge a reasonable fee for this service as administrative expenses, unless the loss or damage is due to negligence on the part of the carrier or its agent.

 

(h) When such evidence is not available or when the passenger does not sign the agreement, the carrier issuing the ticket can ask the passenger to pay the total price of the ticket. The passenger may exercise their right to a refund, provided that the carrier that issued the original ticket accepts that the lost or damaged ticket has not been used before its expiry date or in the event that the passenger finds the original ticket before its expiry date.

 

(i) A ticket is a valuable object, and passengers must take the appropriate measures to preserve it and ensure that it is not lost or stolen.

 

(j) If the passenger travels with a reduced fare or under special conditions, they must be able to demonstrate these conditions or the reasons for the discount at any point during the trip.

 

2. Validity period

(a) Except when, on the ticket, in these conditions of carriage or in the fare, as defined in Article 1, a clause has been included that limits the validity of a ticket (in which case the limitation must appear on the ticket), a ticket is valid:

 

  (i) One year from the issue date, or

  (ii) Subject to the first trip made within one year from the date of issue, one year from the date of the first trip stated on the ticket.

 

(b) When the passenger is prevented from travelling within the validity period of their ticket because at the time they make the booking Air Europa is not in a position to confirm it, the validity period of the ticket will be extended or the passenger will be entitled to request a refund in accordance with Article 10.

 

(c) If, after purchasing the trip, the passenger is prevented from starting the trip or continuing it within the validity period of the ticket due to a hospitalization or illness that makes it impossible to travel by plane, we can extend the validity period of the ticket until the date on which the passenger is fit to travel, or until our first flight after that date, from the point at which the passenger restarts the trip in the seat available in the travel class or service he/she paid for. The passenger must show a hospitalization or medical certificate that proves his/her inability to fly on the date of the flight plus or minus 3 days. The validity of the ticket can be extended up to 45 days from the date of the initial flight, with an additional 45-day extension if a new, updated certificate is provided.

The change will be to the same class of travel as initially purchased; if not available, the corresponding difference must be paid. In such circumstances, we will also extend the validity period of the tickets of other direct relatives accompanying the traveler.

 

(d) In the event of the death of a passenger during the journey, the tickets of the people accompanying the deceased traveler may be modified, with the minimum stay clause no longer applicable or its validity extended. In the event of the death of a direct relative of a passenger who started the trip, the validity of the ticket of the passenger and of any direct relatives traveling with him/her may also be modified. In the event of death, the margin is extended up to 20 days between the death and the day of the flight. 

 

(e) To benefit from the modifications mentioned in sections (c) and (d) above, a valid hospitalization, doctor's or death certificate must be provided. The validity of the ticket will be extended for a period of no more than forty-five (45) days from the date of the original flight.
 

3. Sequence and use of the coupon

(a) The ticket purchased is only valid for the journey stated thereon from the place of departure to the final destination, as well as any intermediate stopovers that may have been agreed. The amount paid is based on the Air Europa fare and covers the journey indicated on the ticket. The ticket is part of Air Europa's Contract of Carriage with the passenger.

 

(b) If the passenger wishes to change some aspect of the carriage, they must first contact Air Europa. The fare for the new carriage will be calculated, and the passenger will be given the option of accepting the new amount or maintaining the original carriage as stated on the ticket.

 

(c) The passenger must be aware that, while some changes will not result in a change in the fare, others, such as changing the departure point (e.g. if the first segment/coupon has not been used) or the direction has been reversed, can result in an increase in the price. Many fares are only valid for the dates and flights indicated on the ticket, and in no case can they be changed; if they are changed, an additional amount must be paid.

 

(d) Each flight coupon included in the passenger's ticket will be accepted for carriage in the service class, on the date and on the flight for which the seat was booked. When a ticket is issued without specifying the booking, the passenger can reserve the seat according to our fares and according to the availability of seats on the requested flight.

 

(e) If the passenger does not use an outbound flight, Air Europa would be grateful if they would advise whether or not they are going to use the return flight or subsequent reservations in order to better manage seating. Failure to notify this information will have no consequences for the passenger's reservation.

 

4. Name and address

Air Europa's name may appear as an abbreviation on the ticket using our designator code (UX/AEA) or otherwise. Air Europa's address will be considered the address of the airport of departure shown on the ticket, together with the first abbreviation of the Air Europa name in the carrier box or, in the case of an electronic ticket, as indicated for the first segment of the Air Europa flight in the itinerary receipt ("Travel Information").

1. Price of the ticket

The price applies only to the carriage from the airport at the point of origin to the airport at the destination, unless otherwise indicated. The price includes the carriage of checked baggage only if the fare includes baggage allowance, in which case the respective conditions will be applied. The price does not include ground transport between airports and between airports and terminals in the city. The price will be calculated according to the fares in force on the date of payment of the ticket for travel on the dates and according to the itinerary indicated thereon. If the passenger changes the itinerary or the dates of the trip, this may affect the price that they have to pay for the ticket.

2. Itinerary

Unless otherwise stipulated in our Contract of Carriage or in any other contractual agreement, the price of the ticket applies only to the itineraries stated thereon. If the price includes more than one itinerary, the passenger can specify which one they prefer before the ticket is issued. If no itinerary is specified, Air Europa will determine it.

3. Taxes, duties and fees

The applicable taxes and duties that the passenger must pay are fees imposed by governments or other authorities or airport operators. At the time of purchasing the ticket, the traveller must be notified of the taxes, duties and fees not included in the price, most of which will normally be indicated separately on the ticket. The taxes, duties and fees that apply to air travel change constantly and can even be imposed after the date of issue of the ticket. If an increase in the tax, duty or fee indicated on the ticket occurs in accordance with applicable legislation, the passenger must pay the corresponding difference. Similarly, if any tax, duty or fee that the passenger has paid to Air Europa at the time of issuance of the ticket is eliminated or reduced in such a way that is no longer applicable or a smaller amount needs to be paid, the passenger will be entitled to claim the corresponding amount.

4. Currency

The price of the ticket, taxes, duties and fees are paid in the currency of the country in which the ticket is issued, unless Air Europa or our Authorised Agent indicates another currency before or at the time of payment (e.g. because the local currency is not convertible). We may accept payment in another currency as we see fit.

1. Booking requirements

(a) Air Europa or our Authorised Agent will register your booking(s). If you wish, you can request a written confirmation of your booking.

(b) Certain fares may have conditions that limit or exclude your right to change or cancel the booking.

2. Ticket issuance deadline

If the passenger has not paid for their ticket before the specified deadline as per the instructions of Air Europa or its Authorised Agent, these may cancel the booking and open the corresponding seat for sale to another party.

3. Personal data

All personal data will be processed by Air Europa in accordance with the provisions of its Privacy Policy.

The data will be held throughout the term of the contractual relationship. Once this contractual relationship has ended, we will keep your data blocked for the length of time imposed for responding to any obligations that may have arisen from the data processing and/or the applicable legal periods, whereby such data can be made available to the competent bodies for dealing with any possible liability resulting from its processing.

4. Seat assignment

Passengers have the right to a prior, free of charge seat assignment within 48 hours from the departure time of the flight.

This seat will be assigned by Air Europa, unless you choose to use the seat selection assignation service, in which case passengers may choose their seat from among those available. This service includes a fee.

Notwithstanding the above, and for operational or flight security reasons, Air Europa may reassign already assigned seats at any time, including after boarding.

If, due to operational reasons, Air Europa is obliged to reassign a seat selected by the passenger, it will try to reassign the passenger a seat with similar characteristics to the one selected. If this is not possible, the passenger will have the right to a refund for the service.

5. Booking reconfirmation

a) Successive bookings or return bookings may be subject to reconfirmation within a specified time limit. When applicable, the passenger will be notified that they must carry out reconfirmation, at which point they will be told how and where to do it. If the notification has been made and the passenger does not carry out the reconfirmation, Air Europa can cancel the successive bookings and the return bookings.

(b) Passengers must check the requirements for reconfirmation, as defined in Article 1, for any carrier involved in their journey. When necessary, the passenger must reconfirm the booking with the carrier whose airline designator code is shown on the flight corresponding to the ticket.

1. Baggage check-in times are different at each airport, and Air Europa recommends that passengers consult and respect them. In an effort to enable you to comply with all government formalities and departure procedures sufficiently in advance of the flight's departure, the passenger must arrive at the carrier's baggage check-in desk and the boarding gate within the time indicated by the carrier. If the passenger has no checked baggage or their fare does not allow checked baggage, they can go straight to the boarding gate with their boarding card, otherwise they must go to the check-in desk to retrieve their boarding card. Air Europa reserves the right to cancel the booking if the passenger does not comply with the stated baggage check-in times. Air Europa or its Authorised Agents will inform passengers of the times for checking baggage and boarding for the first flight. In the case of connecting passengers, they must consult the times for checking baggage and boarding for subsequent flights. In the case of codeshare flights operated by another airline, the airline operating the flight sets the time limit.

Air Europa will not be liable to passengers for any loss or damage caused by their failure to comply with the provisions of this article.

 

 

2. If the passenger does not arrive in time at the baggage check-in desks or the boarding gate or if they do not have the appropriate documentation as per Article 13 and therefore are not in a position to travel, Air Europa may cancel the seat booked in their name and make different arrangements for it without any obligation whatsoever to the passenger, unless applicable local regulations state otherwise.

 

 

3. Whenever the flight voucher has not been removed from the ticket at the time the passenger receives their boarding card at the baggage check-in counter, said flight voucher will remain in the passenger's possession until they are required to present it when boarding.

 

 

4. Passengers may select the priority boarding service, with the payment of the corresponding fee, which will give them the right to board before other passengers who have not selected this service. This right will be notwithstanding the boarding priority of passengers flying in Business class or holders of the SUMA Gold or Platinum card.

1. Right to deny carriage

Air Europa may deny carriage for safety reasons (flight or law enforcement) or, applying its reasonable criteria and at any point during boarding and/or connection, may refuse to carry passengers and baggage if any of the following situations occurs, or we have to reason to believe it may occur:

(a) The passenger does not comply with applicable laws, regulations or government provisions.

(b) Carriage of passengers and/or baggage may endanger or affect safety and health or materially affect the comfort of other passengers or crew;

(c) If the passenger's mental and/or physical state, including problems caused by alcohol or drugs, is a danger or a risk to themself, to other passengers and/or the crew or to the belongings of passengers, the crew or Air Europa;

(d) The passenger has used threatening, abusive or insulting words and/or has behaved in a threatening, abusive, insulting or undisciplined manner towards a member of our ground staff or a member of the aircraft crew;

(e) The passenger is, or Air Europa reasonably believes that the passenger is, in illegal possession of drugs or any other illegal substance;

(f) The passenger has endangered the safety of the aircraft and/or any person inside it;

(g) The passenger has committed a crime during the booking, billing or boarding process, or on board the aircraft before take-off;

(h) The passenger has behaved incorrectly on an earlier flight, and Air Europa has reason to believe that such behaviour may be repeated;

(i) The passenger has refused to undergo personal security checks or baggage checks, as stipulated in Articles 8.5 and 13.6, or the passenger has refused to duly prove their identity;

(j) The passenger has not paid the price of the ticket, taxes, duties or the applicable fees;

(k) The passenger does not appear to have valid travel documents, attempts to enter a country where they can only take a connecting flight or for which they do not have valid travel documents, has destroyed their travel documents during the flight or refuses to present them to the flight crew or land personnel, against receipt, when requested, and/or has expired documents that do not comply with governmental or international requirements or regulations in force or false documents, either due to identity theft or document forgery;

(l) As regards the presented plane ticket:

   (i) It was acquired illegally or was purchased from a company that is not Air Europa or any of its Authorised Agents; or

   (ii) There is information that it is a lost or stolen ticket, or

   (iii) It is a false ticket; or

   (iv) It contains a flight coupon that has been modified by someone who is neither Air Europa nor any of its Authorised Agents or that has been damaged.

(m) The passenger has not complied with the requirements set out in Article 3.3 regarding the sequence and use of the coupon;

(n) When checking baggage or boarding the flight, the passenger requests special assistance from the carrier that was not requested and confirmed ahead of time;

(o) The passenger has not complied with one or more of the applicable instructions and provisions relating to safety matters;

(p) When presenting the plane ticket, the passenger cannot prove that they are the person whose name appears in the box "Passenger name";

In cases (k), (l), (m) and (p) Air Europa reserves the right to confiscate the passenger's ticket.

2. Special assistance

(a) The acceptance of unaccompanied minors, persons with functional diversity, pregnant women, sick people or other people requiring assistance is subject to prior agreements with Air Europa, which are formalised by signing the corresponding form, when applicable. Passengers with reduced mobility who, upon purchasing the ticket, notified Air Europa of their special request and have obtained confirmation from Air Europa will not be denied carriage by virtue of this special request.

(b) If the passenger needs Air Europa to serve him a special meal on board their flight(s), they must request it at the time of booking or changing a booking or within the time period indicated by Air Europa. Otherwise, Air Europa cannot guarantee that the meal will be available on board the corresponding flight(s). Due to operational conditions, it may not be possible to have some special meals, in which case we do not assume any liability to the passenger.

(c) Passengers with health problems are advised to consult a doctor before they travel by plane, particularly when it comes to long-haul flights, and to take all appropriate precautionary measures.

Furthermore, if passengers make a request within the scope of the special conditions mentioned in sections (a) or (b) of item 2 only when checking baggage, Air Europa will assume no responsibility if it does not comply with or cannot comply with said request and, furthermore, reserves the right to deny boarding in accordance with the terms of section 1(n) of this Article. 

1. Baggage Allowance

Passengers can carry baggage free of charge according to the limitations and conditions set forth in these Conditions of Carriage, which they can request from Air Europa, and in the conditions of the fare applied by Air Europa, provided that said conditions include an allowance, in which case the terms and conditions of each allowance will be applied.

 

 

2. Excess baggage

Passengers must pay a surcharge for baggage that exceeds the permitted allowance according to the rates applied by Air Europa, available at Air Europa or at its Authorised Agents.

 

 

3. Objects that are not accepted as baggage

Passengers should not include the following in their baggage:

(a) Objects liable to endanger the safety of the aircraft, people or goods on board the aircraft or the environment, as specified in the Dangerous Goods Regulations of the International Civil Aviation Organisation (ICAO), in the regulations of the International Association of Air Transport (IATA) and Air Europa regulations applicable to passengers (if requested, Air Europa can provide further information on this matter);

 

(b) objects that are prohibited by applicable laws or regulations of the country from which or to which they are flying;

 

(c) objects which Air Europa considers would be reasonably inappropriate to carry because they are dangerous or unsafe due to their weight, size, shape or character, or which are fragile or perishable, taking into account, among other things, the type of aircraft used. If requested, Air Europa can provide information on objects that are not accepted.

 

(d) Firearms and ammunition that are not to be used for hunting or for sporting purposes are prohibited from carriage and baggage. Firearms and ammunition that are to be used for hunting can be accepted as checked baggage when they are unloaded, the safety device is activated, and they properly packed. The carriage of ammunition is subject to ICAO and IATA Dangerous Goods Regulations, as specified in section (a) above;

 

(e) Weapons such as old firearms, swords, daggers and similar objects can be accepted as checked baggage, according to Air Europa's criteria, but are not allowed to be carried in the aircraft cabin.

 

(f) Fragile or perishable objects, money, currencies, jewellery, works of art, precious metals, silverware, titles or other objects of value, expensive garments, optical and/or electronic devices, cameras of all types, musical instruments, toolboxes, brown and white goods(*), business documents, negotiable securities, passports and other documents, samples and shares, as well as any valuables;

 

(*) NOTE: Brown goods include televisions, audio players, video players, musical equipment, DVD players, home cinema, mobile phones, video games, personal computers, cameras, video cameras and printers. White goods include domestic stoves, ovens, washing machines, dishwashers, refrigerators, extractor hoods, dryers, heaters, air conditioners and kitchen robots.

 

(g) Live animals, except pets and in accordance with the application of the provisions included in section 10 of this Article up to that date.

 

If, despite being prohibited, the passenger's baggage includes any of the objects mentioned in the subsections (a) to (F) of this item, Air Europa assumes no liability for any loss or damage affecting the objects that are not provided for in Air Europa's liability scheme, as defined in Article 15. 

 

 

4. Right to deny carriage

(a) If at any boarding point or intermediate point Air Europa discovers any of the objects described in section 3 as prohibited in baggage, it may refuse to carry it.

 

(b) Air Europa may refuse to carry any object as baggage that it reasonably considers not suitable for transport due to its size, shape, weight, content and character, for safety or operational reasons or for the comfort of other passengers. If requested, Air Europa can provide information on objects that are not accepted as baggage.

 

(c) Air Europa can refuse to carry baggage unless, according to our reasonable criteria, it is properly and securely packed in suitable containers. If requested, Air Europa can provide information on packages and containers that are not acceptable.

 

(d) Air Europa may refuse to carry checked baggage when the ticket's fare does not include a baggage allowance. In these cases, to authorise carriage, the corresponding charges must be paid as excess baggage. These charges will be made publicly available to the passenger.

 

 

5. Right to search

For security reasons, Air Europa can ask passengers to allow it to search or examinate their person or baggage. If the passenger is not present, their luggage may be searched in their absence for the purpose of determining whether it contains any of the objects described in Section 3, such as a firearm, ammunition or other weapon that has not been presented to Air Europa. If the passenger is not prepared to comply with this requirement, Air Europa may refuse to carry the passenger and their baggage. If the search or other type of examination causes damage to the passenger and their baggage, Air Europa will not be held liable unless said damage is due to an error or negligence on its part.

 

 

6. Checked baggage

(a) When the passenger hands over their checked baggage to Air Europa, the latter will assume custody of the baggage and issue a baggage identification tag for each piece of checked baggage.

 

(b) Checked baggage must be marked with the passenger's name or some other personal identification.

 

(c) We will carry checked baggage on the same aircraft as the passenger, unless in special circumstances we decide for operational or security reasons to carry it on a separate flight. In this case, Air Europa will be responsible for delivering it to the passenger, unless any applicable laws state that the passenger must be present for customs clearance.

 

(d) Regardless of the maximum limit allowed in the baggage allowance or the excess baggage allowance, the maximum dimensions per piece is 158 cm (62 in), found by adding the length + width + height of each piece (except for certain special luggage), and the maximum weight per piece is 32 kg (70 lb).

 

(e) Certain checked bags considered special or irregular may be subject to a surcharge, the amount of which can be viewed at: baggage

 

 

7. Hand luggage

(a) Air Europa can specify the maximum dimensions and/or weight of the luggage passengers carry on the plane and/or limit the amount of luggage. Currently, hand luggage has a maximum weight of 10 kg and dimensions no greater than 55 cm x 35 cm x 25 cm (or the sum of the length, width and height is no greater than 115 cm). The luggage that passengers carry on the plane must fit under the seat in front or in a closed storage compartment within the aircraft cabin. If the passenger's luggage cannot be stored in this manner or its weight is excessive or is considered dangerous for any reason, it must be transported as checked baggage. This baggage can be checked at any time before the flight's departure.

 

(b) Objects that cannot be transported in the aircraft's hold (such as musical instruments and similar objects) and do not meet the requirements of item (a) will only be accepted for carriage in a cabin compartment if the passenger has previously notified Air Europa and the latter has granted authorisation to do so. The passenger will likely have to pay an additional charge for this service.

 

 

8. Excess value declaration and fees

Available, except for certain valuable items.

 

 

 

9. Collection and handing over of checked baggage

(a) According to section 6 (c), passengers must collect their equipment as soon as it is available at the destination or stopover. If the passenger does not collect their baggage within a reasonable time, Air Europa may charge a reasonable amount as a deposit. If the baggage is not claimed after six (6) months from the time it becomes available, Air Europa can dispose of it without any liability to the passenger.

(b) Only the person who holds the voucher and the baggage identification tab will be authorised to collect the checked baggage.

(c) If a person claiming the baggage is unable to present the baggage voucher and

identify it using the corresponding identification card, Air Europa will only hand over the baggage to this person, provided that they prove, to Air Europa's full satisfaction, their right to collect it. If Air Europa so requests, this person must provide the appropriate coverage to compensate for any loss, damage or expense that the company may incur as a result of handing it over.

 

 

10. Animals

If Air Europa agrees to carry animals, said carriage will be subject to the following conditions:

(a) Passengers must ensure that animals such as dogs, cats, domestic birds and other pets are properly caged and have valid health and vaccination certificates, entry permits and other documents required by the countries of entry or transit; if the required documents are not presented, these animals will not be carried. Carriage may be subject to additional conditions specified by Air Europa, which are available upon request;

 

(b) If they are accepted as baggage, the animals, together with their cage and food, will not be included in the passenger's baggage allowance, but will be considered excess baggage for which the passenger must pay the applicable fare;

 

(c) Service animals accompanying passengers with reduced mobility, as well as their cage, will be carried free of charge as part of the standard baggage allowance in accordance with the conditions specified by Air Europa, which are available upon requested;

 

(d) When carriage is not subject to the liability rules of applicable law, Air Europa will not be liable for any injuries or loss, illness or death of an animal that it has agreed to carry, unless the company has been negligent.

 

(e) Air Europa will not assume any liability for any animal that does not have all the exit, entry, health and other documents necessary for the entry or transit of said animal into or through any country, state or territory. Furthermore, the person carrying the animal must reimburse Air Europe for any fine, cost, loss or liability reasonably imposed or incurred by Air Europa as a result.

1. Timetables

Before Air Europa accepts a passenger's booking, the passenger will be informed of the scheduled departure time of the flight and it will be shown on the ticket. The scheduled departure time may change after the ticked has been issued for reasons beyond the control of Air Europa. In this case, the company will send a notification of any changes to the contact information provided on the reservation. If this change is significant in the scheduled flight timetable, Air Europa will offer the following options from which the passenger is free to choose

i) an acceptable alternative flight; or

ii) reimbursement of the ticket, without prejudice to any other rights corresponding to them, where applicable, in accordance with applicable legislation.

2. Cancellation, change of itinerary, delays

If the carriage is carried out as per a charter agreement, these Conditions of Carriage are applied according to the terms stated in the charter agreement or on the ticket.

(a) Air Europa will take all necessary measures to avoid delays in the carriage of passengers and baggage. In applying these measures and in order to prevent the cancellation of a flight, Air Europa may, in exceptional circumstances, arrange for a flight to be operated on its behalf by another carrier, in accordance with the terms of Article 1, or provide another means of carriage.

(b) Without prejudice to the provisions of the applicable law, if Air Europa cancels a flight, does not reasonably carry out the flight according to the timetable, does not leave passengers at the stopover or destination locations, or is responsible for passengers losing a connecting flight for which they had a booking confirmed through a single Contract of Carriage, Air Europa, at the passengers' choice, will do the following:

(i) carry passengers free of charge on another scheduled Air Europa flight with available seats at the first opportunity and, where necessary, extend the validity of the ticket; or

(ii) within a reasonable period of time, offer new carriage by air for the passengers' itinerary to the destination indicated on their ticket, either by Air Europa or another carrier, as defined in Article 1, or another mutually agreed means and class of carriage, without additional charges. If the price of the ticket and the modified itinerary fees are lower than the refund value of the ticket or the applicable part thereof, we will refund the difference; or

(iii) we will make the refund in accordance with the provisions of Article 10.2.

(c) In accordance with the provisions of applicable legislation, in particular with regard to Regulation 261/2004, in the event of cancellation or delay of a flight of more than two hours, the passenger may request the text containing their rights at the check-in counter or at the boarding gate

3. Denied boarding

In accordance with the provisions of applicable legislation, in particular with reference to Regulation 261/2004, in the event the passenger is denied boarding, they may request the text containing their rights at the check-in counter or at the boarding gate.

1. General conditions

 

Air Europa will refund any unused ticket or part of the ticket in accordance with applicable pricing rules or fares, as follows:

 

(a) Except for the provisions of this Article, Air Europa must refund the person whose name appears on the ticket or the person who has paid for it, following submission of satisfactory proof of such payment;

 

(b) If a ticket has been paid by a person other than the one whose name appears on the ticket and if the ticket indicates that there is a limitation on said refund, we will only refund the person who has paid the ticket or as ordered by that person;

 

(c) Except in the event of loss of the ticket, refunds will only be made after Air Europa receives the passenger coupon and all unused flight coupons;

 

(d) If a refund is made to a person who presents a passenger coupon and all unused flight coupons in accordance with the provisions of the previous subsections (a) or (b), the refund will be considered correct and Air Europa will be exempt from all liability and any subsequent claim for refund.

 

(e) Passengers will be entitled to a refund of the taxes imposed by governments or other authorities or the airport operators corresponding to the unused part of the ticket, unless they have already been paid or must be paid, despite not being used, to the governments, authorities or airport operators. Refunds will only be made at the passengers' request by the carrier that originally issued the ticket or by its agent, in the case they are authorised to do so.

 

(f) All refunds, including taxes referred to in section e), unless it is an involuntary refund or any other which the company is obliged to make for reasons expressly established by current legislation, will be subject to the payment of a charge whose amount will be made available to the passenger by Air Europa or its Authorised Agents.

(g) Subject to the applicable legislation in each territory, Air Europa may offer passengers a change of booking or a voucher or credit as an alternative to refund, especially when the right to a refund arises from extraordinary circumstances outside the control of the company, such as Force Majeure or unforeseeable circumstances.

 

2. Involuntary refunds

 

If Air Europa cancels a flight, does not reasonably carry out the flight according to the scheduled timetable, does not leave the passenger at the stopover or destination locations or is responsible for the passenger losing a connecting flight for which they had a booking confirmed through a single Contract of Carriage, the refund amount will be:

 

(a) If no part of the ticket has been used, an amount equal to the price of the ticket paid;

 

(b) If a part of the ticket has been used, a quantity not less than the difference between the price of the ticket paid and the price applicable to the trip between the points for which the ticket has been used. Unless the flight no longer makes sense in relation to the travel plan, in which case the amount of the ticket price paid will be refunded.

 

(c) If, after purchasing the trip, the passenger is prevented from starting the trip or continuing it due to death, hospitalization or illness that makes it impossible to travel by plane on the date of the flight, plus or minus 3 days (extended to 20 days in the case of death), the ticket may be refunded, or the date can be changed, as per Art. 3.2 (c) and (d).

 

 

3. Voluntary refund

 

(a) If passengers are entitled to a refund for reasons other than those stipulated in section 2 of this Article, the amount of the refund will be:

 

(a) If no part of the ticket has been used, an amount equal to the price of the ticket paid, less all reasonable service charges or cancellation rights;

(b) If a part of the ticket has been used, a quantity not less than the difference between the price of the ticket paid and the price applicable to the trip between the points for which the ticket has been used, less all reasonable service charges or cancellation rights;

 

(b) The refunds stipulated in section 3 are not applicable when any government requirements or Air Europa regulations exclude them, when passengers are informed that the ticket fare does not allow cancellations or refunds or when the ticket contains the comment "NON-REFUNDABLE".

 

 

4. Refund for lost or stolen tickets

 

If the passenger loses their ticket or any part thereof, or it has been robbed, they must present satisfactory proof of said loss or theft to Air Europa and pay a reasonable charge for administrative expenses. At this point, they will be reimbursed as soon as possible after the ticket is no longer valid, provided that:

 

(a) The lost or stolen ticket, or part thereof, has not been used, refunded or replaced previously;

 

(b) The person to whom the refund has been made agrees, as prescribed by Air Europa, to return the refunded amount in the event of fraud and for the amount in which the lost or stolen ticket, or part thereof, is used.

 

(c) If Air Europa or its Authorised Agent loses the ticket or part thereof, the loss will be the responsibility of Air Europa.

 

 

5. Right to deny a refund

 

Air Europa may refuse to take action on a refund:

 

(a) When the request is submitted after the ticket is no longer valid;

 

(b) For a ticket that has been presented to Air Europa, or to government officials in a country, as proof of the passenger's intention to leave the territory of that country, unless the passenger proves, to our full satisfaction, that they are authorised to stay in the country or that they will leave the country on the flight of a carrier, in accordance with Article 1, or by any other means of transport;

 

(c) If the passenger has not been granted entry by the local authorities at their destination or at some intermediate point and, as a result, has been returned to their departure point or to another point;

 

(d) If the ticket was stolen or falsified;

 

(e) If the passenger claims a refund in a currency other than the currency used to pay for it;

 

(f) If the ticket fare indicates that it does not allow cancellations or refunds or contains the comment "NON REFUNDABLE";

 

(g) In the cases stipulated in Articles 11.1 and 11.2.

 

(h) If the passenger does not comply with the provisions of Art. 13.2.

 

 

6. Currency

 

(a) As per applicable law, Air Europa reserves the right to make a refund in the same method and in the same currency used to pay for the ticket.

 

(b) If Air Europa accepts a refund in another currency other than the currency used to make the payment, said refund will be made at the exchange rate(s) and under the conditions established by Air Europa.

 

 

7. Who refunds the ticket?

 

Refunds will only be made by the carrier that originally issued the ticket or by its agent, if they are authorised to do so.

1. If, according to our reasonable criteria, the behaviour of passengers on board endangers the safety of the aircraft or the safety of a person or property on board, prevents crew from performing their duties or does not comply with crew instructions, including, but not limited, instructions concerning the prohibition of smoking or the consumption of alcohol or drugs, or causes discomfort, disturbance, damage or injury to passengers or crew, or any property, Air Europa may take the measures it deems reasonably necessary to prevent the continuation of such behaviour, including coercive measures. Passengers can be disembarked at any point and can be refused transport on other flights. Furthermore, legal proceedings can be brought against them for violations committed on board the plane.

 

2. The passenger will compensate Air Europa for all costs incurred due to their inappropriate conduct on board the aircraft or at the airport. If the plane is forced to divert to an unscheduled location due to the passenger's behaviour, the resolution of the matter may result in the passenger being handed over to the security agents or legal authority at the point of diversion.

 

3. If, as a result of the passenger's conduct, the crew decides to divert the aircraft for the purpose of disembarking him or her, the passenger must compensate Air Europa for all costs and expenses incurred, whatever their nature, as a result of, or arising from, said deviation. If the passenger causes any type of damage or his or her actions cause Air Europa to incur any cost, Air Europa will hold him or her responsible for said cost, damage or other liability incurred. Air Europa may require the passenger to bear the costs incurred as a result of these provisions, reserving any legal actions it deems appropriate to recover them before the competent Courts.

 

4. For safety reasons, Air Europa will prohibit or limit the use of electronic equipment on board the aircraft, including, but not limited to, mobile phones, laptops, portable recorders, CD players, portable radios, video games or transmitters, radio-controlled toys and walkie-talkies. Passengers are allowed to use hearing aids and pacemakers.

 

5. Passengers are prohibited from drinking alcoholic beverages on Air Europa flights when alcohol has been provided by passengers or other third parties.

 

6. In order to safeguard the personal data and the right to privacy of passengers and company staff and their agents, be it their right to reputation, privacy or image, the taking of photographs or videos and/or the recording of conversations without the prior and express consent of both the passenger and the company's staff and their affected agents is not allowed. Similarly, the aforementioned photographs, videos or audios are not allowed to be disseminated or distributed in public or private, including on social media.

1. If you purchase a service not related to air transport that is promoted through the Air Europa website, you will be entering into a contract with a third party, meaning that said contract will be governed by the terms and conditions set out by said third party, which will be solely responsible for the provision of the service.

2. If you purchase insurance through the Air Europa website, it will be governed by the terms and conditions set out by the insurer, and you must contact the insurer in relation to any matter related to this service.

3. If you contract the services offered by Air Europa Holidays, you will be signing a contract with a third party, meaning Air Europa Líneas Aéreas S.A.U. will not be responsible for the proper execution of said services, which will be governed by the terms and conditions established for this purpose on its website, which you can find at the following link: https://holidays.aireuropa.com/byl/aviso-legal/

4. If the entity responsible for providing the services that comprise Air Europa Holidays becomes insolvent, Air Europa Líneas Aéreas S.A.U. shall not be liable. In this case, the guarantee provided by that entity shall apply, in accordance with Royal Legislative Decree 1/2007 of 16 November, and in Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements.

1. General conditions

(a) Passengers are responsible for obtaining all travel documents and visas necessary to comply with all laws, regulations, ordinances, provisions and requirements pertaining to travel, visas and authorisations applied by the states or countries from, to or through which they fly; all passengers, including transit passengers, must comply with the requirements of states or countries related to immigration and border control.

(b) Air Europa will not be responsible for the consequences for passengers if the latter fail to obtain said documents or visas or if they breach the requirements mentioned in subsection (a) above.

2. Travel documents

(a) Before the trip, at the request of Air Europa, passengers must present all exit, entry, transit, health and other requirements as required by the laws, regulations, ordinances, provisions or other requirements of the states or countries concerned and allow Air Europa to take copies or keep copies of them.

(b) Air Europa reserves the right to refuse carriage if passengers have not complied with the requirements mentioned in the previous sections or if the travel documents do not appear to be in order.

3. Denial of entry

Passengers who are denied entry to any state or territory will be responsible for paying any fine or charge that this state or territory charges to Air Europa and the cost of carriage from that state or territory. The cost of the ticket for carriage to the point where passengers have been denied entry will not be refunded by Air Europa.

4. The passenger will be responsible for paying fines, detention costs, etc.

If Air Europa is required to pay or deposit a fine or penalty, or if it must incur any expenses as a result of the passenger's failure to comply, voluntarily or involuntarily, with the laws, regulations, ordinances, provisions or other requirements of the states or territories, or failure to present the required documents, the passenger must reimburse Air Europa, at its request, for any amount paid or deposited and any expenses incurred for this reason. To that payment or expense, Air Europa can apply the value of any unused passenger ticket or any refund in favour of the passenger in our possession.

5. Customs inspection

When required, passengers must be present during inspection of their checked or unchecked baggage by Customs officials or other government officials. Air Europa will not be liable to passengers for any loss or damage suffered during this inspection or for the passenger's failure to comply with these requirements.

6. Security inspection

Passengers and/or their baggage must undergo all security checks carried out by government officials, airport authorities and any carriers involved, or by Air Europa, as set out in Article 1.

7. Personal data transfer to Authorities

Passengers expressly consent to the transfer of the personal data they provided to book their flight to the authorities of EEA member states, as well as other countries that legally require it.

For the purposes of the applicable law, carriage that must be carried out by several successive carriers under a single ticket or a connecting ticket is considered a single operation. It is understood that each carrier is solely responsible for the carriage that it carries out. However, passengers must take into account the provisions of Article 15.1.c (i).

1. General considerations

In accordance with Article 1, the responsibility of Air Europa and that of any carrier will be determined by the Conditions of Carriage established by the carrier issuing the ticket, unless otherwise stipulated. The rights corresponding to the passenger will be of a strictly personal nature, and they may not be transferred to another person. Air Europa assumes the following liability:

(a) Carriage is subject to the rules and limitations concerning the liability established by applicable law.

(b) Except in the case of public and social insurance or similar bodies or any subrogated party in accordance with applicable laws, Air Europa agrees to waive any limitation on liability in the event of death, injuries or any personal damage suffered by a passenger, if the accident, in accordance with applicable law, took place on board the plane or in the course of any passenger boarding or disembarking, as provided for in applicable law.

(c) To the extent that the above does not conflict with the content of these Conditions of Carriage and without prejudice to the provisions of current legislation:

(i) With regard to checked baggage, passengers will have the right to take action against the first and last carrier implicated in the air travel, or any other carrier operating an intermediate flight segment, provided they can demonstrate that the damage, destruction or delay of the said baggage occurred there;

(ii) Liability will be limited to the damages shown and in no case will Air Europa be liable for indirect damages, as well as for any form of non-compensatory damages;

(iii) Air Europa is not liable for any damage resulting from its compliance with the laws, government regulations, ordinances or requirements, or from the passenger's breach thereof;

(iv) Air Europa is not liable for any damages affecting unchecked baggage, unless they are due to our negligence and are substantiated by evidence presented by the passenger;

(v) Air Europa will not be liable for any illness, injury or disability, including death, attributable to the physical or mental condition of the passenger or due to the worsening of the said condition;

(vi) The Contract of Carriage, including these Conditions of Carriage and the exclusions or limitations of liability, applies to the Authorised Agents of Air Europa, civil servants, employees and representatives to the same extent that it applies to Air Europa. The sum recoverable from Air Europa and the authorised Agents, employees, representatives and individuals will not exceed the sum corresponding to Air Europa's liability, if any;

(vii) Any liability that Air Europa has will be reduced or even exonerated in accordance with applicable law if the passenger has caused or contributed to said damage;

(viii) None of these Conditions of Carriage will nullify any exclusion or limitation of Air Europa's liability, in accordance with the relevant applicable law.

2. Provisions applicable to both international and domestic flights

(a) Bodily injuries:

(b) In accordance with applicable law, Air Europa will be liable for damages in case of death or injury or any other bodily harm suffered by the passenger if the accident which caused the damage occurred on board the aircraft or during boarding or disembarkation, without prejudice to the exclusions of Air Europa's liability below;

(ii) However, Air Europa's liability may be reduced, or it may even be exonerated for the damage caused, if the company proves that:

  • the death, wounds or other bodily injury were due to the health or physical or mental condition of the passenger prior to boarding; or
  • the damage, according to subsections (a) and (i) of this section, was caused or favoured by the passenger's negligence or their health prior to boarding.

(iii) There is no economic limit for liability in the event of injury or death of the passenger. For damages of up to 128,821 SDRs (approximately 159,042 euros), the airline cannot contest compensation claims. Above this amount, the airline can only contest a claim if it can prove that it was not negligent or otherwise at fault or that the damage was due solely to the negligence or other wrongful act or omission of a third party.

(iv) Recoverable sum due to damage:

  • The recoverable sum will cover the repair of the damage, as determined in an amicable settlement, according to the opinion of an expert or a competent court;
  • Air Europa will compensate the passenger for the compensatory damages recoverable only and for the part that exceeds all payments received from a public social insurance institution or another similar institution.

(v) Air Europa reserves all rights to appeal against third parties, including, without limitations, the rights of subsidy and compensation;

(vi) In the event of death, injuries or bodily harm as a result of an air accident, according to applicable law and Section 2 (a) (i) of this Article, the person(s) entitled to compensation, when identified(s), will be offered advance payment to cover their immediate needs. In the event of death, this advance payment must not be less than the equivalent in EUROS of 16,000 SDRs (approximately 19,754 euros) per passenger. In accordance with applicable law, the advance payment will be made within fifteen (15) days following the identification of the person(s) entitled to compensation and will be deductible from the final amount to be paid for liability in accordance with section (a).

(b) Delay:

(i) Characteristics of compensable damage:

  • Delay as such is not cause for damage: only direct damage will be eligible for compensation; any indirect damage or any form of non-compensatory damage is excluded;
  • Passengers must demonstrate the damage caused by the delay;

(ii) Scope of the liability:

  • Air Europa will not be liable for the damages caused as a result of a delay if the company proves that it has taken all the necessary measures to prevent it or that it was impossible for it to take such measures;
  • Air Europa will not be liable for any damages following a delay caused by passengers or to which passengers have contributed;

(iii) Scope of the compensation:

  • The sum of the redress is determined by the damage according to the evidence presented by the passenger and falls within the limitations contained in the applicable law (up to 5,346 SDRs or approximately 6,600 euros)
  • In the event of delay in the delivery of checked baggage, Air Europa can, by means of a lump sum, compensate passengers for their basic expenses caused by the delay when it occurs outside the place where the passengers currently reside.

(c) Baggage:

(i) Exclusion of liability:

  • Air Europa will not be liable for damage to baggage if caused by possessions inside it. If the passenger's belonging causes injuries to another person or damages the property of another person or the property of Air Europa, the passenger must compensate Air Europa for all losses and for the expenses incurred by Air Europa as a result;
  • Air Europa does not assume liability for the transport of objects not accepted as baggage, in accordance with Article 8.3.
  • Air Europa will not assume any specific liability other than that which corresponds to it in accordance with the provisions of the following subsection (ii).

(ii) Compensation amount:

  • Baggage delays: In the event of baggage delay, Air Europa is liable for damage provided that it has not taken all reasonable measures to prevent the damage or that it has been impossible for it to take such measures. Liability in the event of baggage delay is limited to 1,288 SDRs (approximately EUR 1,590).
  • Destruction, loss or damage to baggage: Air Europa will be liable in case of destruction or loss of, or damage to, the luggage up to the amount of 1,288 SDRs (approximately 1,590 euros). With regard to checked baggage, it is liable even when it is not at fault, unless the baggage is already damaged. With regard to unchecked baggage, the airline is only liable for damage caused due to its fault.

3. Online dispute resolution platform

In accordance with Regulation (EU) No. 524/2013, Air Europa hereby notifies that a European platform for resolving disputes online is in place to facilitate out-of-court settlement of such disputes for contracts concluded online between passengers and the airline. This platform can be accessed through the following website: http://ec.europa.eu/odr.

Air Europa does not participate in this programme at this time and is not subscribed to an Alternative Consumer Dispute Resolution entity unless it is required by the current regulations of an EU Member State.

1. Notification of baggage claims

(a) When the person in possession of the baggage receipt accepts the baggage at the time of delivery without any complaints, this is sufficient proof that the baggage has been delivered in good condition and in accordance with the Contract of Carriage, unless the passenger proves otherwise.

(b) As per the applicable law, no action for damages, even when justified, will be taken with respect to checked baggage unless the passenger files a claim with Air Europa. If the passenger wishes to file a claim or initiate an action concerning damage to checked baggage, they must notify Air Europa or the Carrier after having discovered the damage, in accordance with Article 1, within seven (7) days, or in the event of delay, with twenty-one (21) days from the date on which the baggage was handed over to them. If no claim is received by the affected passenger within the above periods, they will lose their right to any legal action.

(c) As soon as Air Europa receives a claim for any loss or damage, it will submit a Property Irregularity Report (PIR) with an assessment, if necessary. This Property Irregularity Report will not be considered a claim for the purposes of the provisions of section 1 (b) of this article.

2. Limitation of actions

The right to any legal action before the appropriate courts will expire after two years from the arrival of the aircraft at its destination, or from the day on which the aircraft should have arrived.

3. Time limit

All actions undertaken in accordance with the above sections (1) and (2) must be carried out in writing and within the indicated term.

No agent, employee or representative of AIR EUROPA has the authority to alter, modify or cancel any of the provisions contained in these Conditions of Carriage.
